DIFC Wills serve as an important tool in estate planning, allowing non-Muslim individuals to choose the beneficiaries, opt out of the Shariah Law for asset distribution, and appoint guardians for their minor children. DIFC WSC introduced remote registration of Wills via video conferencing in line with the social distancing norms during the COVID-19 pandemic. Over the video call, two (2) witnesses must be present along with the testator.
With a DIFC Will, a testator can include separate clauses regarding funeral wishes. For instance, the testator may include a wish to have his/her last rites completed in the home country.
As of the date of writing, a DIFC Will can be amended at any point in time after the registration by paying a fee of AED 550. This allows accommodating life events such as a change of marital status, the birth of children, or a change in any beneficiary under the Will.
DIFC WSC has a very simple probate process for the execution of Wills. The probate process can be initiated by filing an application along with a copy of the testator’s death certificate and list of assets.
